Corporate Laws in Pakistan – Companies Ordinance 1984

Today the corporate sector of Pakistan is governed by Companies Ordinance of 1984. The history of corporate law in this region is much older than the history of Pakistan. Great Britain passed Companies Act in 1908 which introduced several important provisions relating to company administrations. In 1913 after five years, Companies Act of 1913 was passed in British India. Pakistan came into being on 14 August 1947 and adopted the companies Act of 1913. In 1959 a company Law Commission was set up to make laws in accordance with modern times. Report of Company Law Commission of Pakistan was published in 1960. Finally the Companies Act of 1913 was replaced by the Companies Ordinance 1984.

Family Laws

The term “Family Law” encompass all such laws, which relate to marriage, divorce, maintenance, custody of children Marriage as recognized in the Muslim faith is a civil contract that legalizes the relationship between a man and a woman and creates rights and obligations amongst themselves. Essentially, a marriage is solemnized when a man offers to marry a woman and she accepts, the consideration being the dower amount. This is regulated by the Muslim Family Laws, 1961, which prescribes the form of the marriage contract (nikahnama) which contains the details of the bride and bridegroom, the fact that both of them have agreed to marry each other and the amount of dower payable to the wife as consideration. A very important column in the nikahnama is column 18, which pertains to whether rights of divorce have been given by the husband to the wife, also known as ‘Tallaq-e-Tafveez’. I shall advert to this very important aspect later on. The marriage is to be registered with the Nikah Registrar who has been licensed to perform such function.

History of codification through Family Law Ordinance: The British left the Muslim Family Law pertaining to nikah and divorce uncodified. The problems that arose were thus bequeathed to the judiciary to sort out. Evidence of nikah was established through unreliable sources and divorce was allowed in the chaotic manner that characterised the male-dominated Muslim society. After 1947, after prime minister Muhammad Ali Bogra remarried against the wishes of his first wife (who was an APWA activist), an effort was made to codify laws pertaining to nikah, divorce and remarriage. In 1955, the Commission on Marriage and Family Laws prepared a Report safeguarding, inter alia, the rights of the woman. The Commission was headed by Justice Abdur Rasheed. It comprised seven members, three women and four men. The Report was written by Justice Abdur Rasheed while a dissenting note to the Report was appended by Maulana Ehtesham-ul-Haq Thanvi, the cleric member of the Commission. The said 'alim' was descended from the famed author of Bahishti Zevar, a guide-book for the married woman that denies her fundamental rights.

Salient features of Muslinm Family Law Ordinance 1961

The Muslim Family Laws Ordinance 1961 adopted some of the provisions of the Report of the Marriage and Family Laws Commission, aiming to reform divorce law and inheritance law relating to orphaned grandchildren, introduce compulsory marriage registration, place restrictions on the practice of polygamy, and reform the law relating to dower and maintenance in marriage and divorce, as well as to amend existing legislation with relation to marriage age. 1. Succession. (Section 4) In the event of death of any son or daughter of the propositus before the opening of succession, the children of such son or daughter, if any, living at the time the succession opens, shall per stripes, receive a share equivalent to the share which such son or daughter, as the case may be, would have received if alive. 2. Registration of marriage. (Section 5) Every marriage solemnized under Muslim Law shall be registered. 3. Union Council Registration Process: (Section 5) For the purpose of registration, the Union Council shall grant licenses to one or more persons, to be called Nikah Registrars, but in no case shall more than on Nikah Registrar be licensed for any one Ward. 4. Marriage Record: (Section 5) The form of nikahnama, the registers to be maintained by Nikah Registrars. This records to be preserved by Union Councils and copies of nikhanama shall be supplied to parties, and the fees to be charged . Any person may, on payment of the prescribed fee, if any, inspect at the office of the Union Council the record preserved under sub-section (5), or obtain a copy of any entry therein. 5 Polygamy. (Section 6) If a person want to contract a second marriage , while his first marriage is existing , he shall have to acquire permission from Arbitration Council and marriage without such permission shall not be registered . 6 Permission from first wife : (Section 6) On receipt of the application, Chairman shall ask the applicant and his existing wife or wives each to nominate a representative, and the Arbitration Council if satisfied that the proposed marriage is necessary and just, grant, the permission applied for marriage. 7 Payment of Dower: (Section 6) Any man who contracts another marriage without the permission of the Arbitration Council shall, pay immediately the entire amount of the dower whether prompt or deferred, due to the existing wife or wives, which amount, if not so paid, shall be recoverable as arrears of land revenue; and Incase of conviction upon complaint may be punished with the simple imprisonment which may extend to one year, or with fine which may extend to five thousand rupees, or with both. 8 Talaq/ Divorce (Section 7 ) Any man who wishes to divorce his wife shall, as soon as may be after the pronouncement of talaq in any form whatsoever, give the chairman a notice in writing of his having done so, and shall supply a copy thereof to the wife. A person fail to do so shall be punishable with simple imprisonment for a term which may extend to one year.

Phishing scams. Cybercrime may threaten a person or a nation's security and financial health.[4] Issues surrounding these types of crimes have become high-profile, particularly those surrounding hacking, copyright infringement, unwarranted mass-surveillance, child pornography, and child grooming. Minister of State for Information Technology and Telecommunication Anusha Rehman said that the amended “Electronic Crime Bill 2016” will be made a law next week to affectively deal with cyber crimes in the country. The amended Bill will be presented before the National Assembly on August 1 (Monday) and would get an easy sail to become a law.

Salient features of bill

Up to five year imprisonment, PKR 10 million fine or both for hate speech, or trying to create disputes and spread hatred on the basis of religion or sectarianism. Up to five year imprisonment, PKR 5 million fine or both for transferring or copying of sensitive basic information. Up to PKR 50 thousand fine for sending messages irritating to others or for marketing purposes. If the crime is repeated, the punishment would be three months imprisonment and a fine of up to PKR 1 million rupees. Up to three year imprisonment and a fine of up to PKR 0.5 million for creating a website for negative purposes. Up to one year imprisonment or a fine of up to PKR 1 million for forcing an individual for immoral activity, or publishing an individual’s picture without consent, sending obscene messages or unnecessary cyber interference. Up to seven year imprisonment, a fine of PKR 10 million or both for interfering in sensitive data information systems. Three month imprisonment or a PKR 50 thousand fine or both for accessing unauthorised data. Three year imprisonment and a fine of up to PKR 5 million for obtaining information about an individual’s identification, selling the information or retaining it with self. Up to three year imprisonment and a fine of up to PKR 0.5 million for issuing a sim card in an unauthorised manner. Up to three year imprisonment and fine of up to PKR 1 million rupees for making changes in a wireless set or a cell phone. Up to three year imprisonment and a fine of up to PKR 1 million for spreading misinformation about an individual.
